Miami Heat Championship Rings Awarded In Glitzy Ceremony (PHOTOS, VIDEO)

MIAMI -- LeBron James held his index finger aloft, then turned and took a walk nine years in the making.

A few moments later, a championship ring ? finally ? was his.

James and the Miami Heat celebrated their NBA title once again Tuesday night, with the ring-and-banner ceremony replete with an indoor fireworks show that immediately preceded their season opener against the Boston Celtics.

NBA Commissioner David Stern handed Heat owner Micky Arison the first ring of the night, and Arison handed the others out to executives, coaches and players.

James went last, as the crowd roared for the reigning NBA MVP.

"It's not given," James said earlier Tuesday. "These moments are not given."

Stern gave brief remarks to the crowd, starting his address by mentioning "those who were affected" by Hurricane Sandy, which struck the East Coast earlier this week. (Stern misspoke and referred to the storm Hurricane Katrina, though his point was clear.) He congratulated Heat executives and coaches, then lauded Miami's players.

"And congratulations to the Miami Heat fans," Stern said.

The only player to address the crowd was veteran Mike Miller, who spoke after warmups.

"We want to thank you guys so much for all your support," Miller said. "Without you guys, a night like tonight's not possible. The journey that starts tonight is going to be even more challenging, so we're going to need your passion, your support and your energy even more. Enjoy the game tonight and let it fly."

The rings had the words "All In" on one side, and "Family" underneath two images of the Larry O'Brien Trophy on the other. James hugged Stern briefly as the commissioner said a few words, then got a few words from Arison before checking out the box that held his newest bauble.

Players posed for a quick photo as the banner started being raised, then James and others took their rings out to examine the detail. He touched the banner as it rose behind him, then went back to checking out the ring.

Soon, they were put away, the lights came on, and the season started.

"I think we all know what another year's all about," James said. "We know what our long-term goal is. But we're not going to take any short cuts. It's a process. It's always been that way for us."

The pursuit of a title is what drove James every year since joining the NBA in 2003, and he had been close twice, ultimately falling in his first two trips to the NBA Finals.

His breakthrough came last June, and James capped his stellar postseason with a triple-double in Game 5 of the finals against Oklahoma City, as the Heat capped off the second title in franchise history.

"I'm not going to take this moment for granted," James said. "It doesn't happen to everyone. I know the history of the game. I am going to live in the moment. Not going to sit here and say I'm not. It's a special moment for not only our team, for our organization, for the city, whoever's a Miami Heat fan, our families, everything. We'll live in the moment, but we also have some other business to take care of as well."

In the long term, that means another title.

In the short term, that meant getting ready for Boston.

Miami's first ring night was an unmitigated disaster ? a 108-66 loss to the Chicago Bulls after the 2006 championship jewelry was issued. The Heat were on the other end of a banner blowout last Christmas in Dallas, where in a finals rematch they ran out to a 35-point lead shortly after halftime.

The Heat were clearly inspired by having a chance to put a damper on Dallas' day. And they expected the Celtics to feel the same way, after Miami ousted Boston in last season's Eastern Conference finals and then lured Ray Allen away in a free-agency coup over the summer.

"We were hoping that Oklahoma was playing Miami on opening night to watch ring night," Celtics coach Doc Rivers said. "I don't know why they chose us. But it is what it is. They deserve it. They won it last year. They get to have their day. We had our day and LeBron had to sit and watch that.

"It's his payback night," Rivers added. "And he deserves it. He really does. He's probably gone through more scrutiny than any player, maybe any athlete, that I can ever remember. In that light, I'm happy for him."

The Celtics were not on the court for the ceremony, which preceded the usual pregame warmup period.

"To be able to raise that banner in front of our fans, it took a tremendous amount of work collectively," Heat coach Erik Spoelstra said. "We don't want to diminish that."

Hurricane Sandy causes detour for 3,000 passengers

Three cruise ships are making unscheduled calls in Halifax this week due to hurricane Sandy.

A total of about 3,000 people aboard Navitrans?s The World, NCL?s Norwegian Dawn and Oceania?s

Regatta are extending the city?s cruise ship season for a few days.

?The ships were generally avoiding the East Coast of the U.S.," said Michele Peveril, who speaks for the Halifax Port Authority.

The World arrived Sunday and is slated to leave today. Norwegi?an Dawn came in Monday and is scheduled to leave today. Regatta also arrived Monday is expected to stay a few nights.

?It?s unusual to have a ship in for two overnights," Peveril said. ?But because we have multiple berths and space to take up to five cruise ships a day, it gives us that added flexibility to basically support the cruise lines and the customers when they?re looking for a safe harbour for a day or two."

Earlier this fall, Halifax lost the chance to host about 2,300 pas?sengers whose ships were diver?ted away from Halifax on Sept. 13 and 17 due to hurricane Leslie.

Vogelsong, a career journeyman whose path to the World Series took a detour to Japan and Venezuela, improved to 3-0 with a 1.09 ERA in four starts this postseason.

"I knew my stuff was pretty good," Vogelsong said. "I was really pumped up to be out there."

Vogelsong induced two early double plays, then faced his stiffest test in the fifth.

The bases were loaded with one out when Vogelsong fanned rookie Quintin Berry. That brought up Cabrera, honored on the field before the game with an actual blue-and-gold crown for his Triple Crown accomplishments.

Credit Suisse posts 63 percent drop in 3Q profits

(AP) ? Credit Suisse Group has posted a 63 percent decline in third-quarter net profits over a year ago in the same quarter.

Switzerland's second-biggest bank says it had net profits of 254 million Swiss francs ($272 million) between July and September, compared with 683 million francs ($785 million) in the comparable period of 2011.

The company attributed the decline to an accounting charge on the bank's own debt.

The Zurich-based bank said in a statement Thursday before the opening of the Zurich exchange that it intends to cut another 1 billion francs in costs in 2014 and 2015, on top of 3 billion in previously announced cost-cutting measures it plans to have achieved by the end of next year.

Chief Executive Brady Dougan said the bank has "significantly cut costs and improved efficiencies" while also reducing risks and strengthening its capital cushion.

3 Advanced Outsourcing Automation Techniques | Kaizenify

Rasmus LindgrenNow I have to be blunt, this is not a ?starter article? on outsourcing. If you haven?t outsourced anything before you should probably start somwehere else.

So I assume that you have some kind of outsourcing experience.

In this article I will give you three advanced strategies for managing your outsourcing process. You can also yink of this as a basic outsourcing management framework.

When you start out with outsoucing you typically have some kind of project management system to track your projects or tasks. Perhaps you have also just used email for commicating with your staff. While email is a great tool for communication it can quickly become very hard to manage projects and tasks over time.

So a first quick tip could be to setup some kind of project management tool. Whether that is something like Basecamp that is hosted and is super simple to use, or something you install on your hosting account like PHPProjekt that can be installed with a one click installer on most hosting accounts doesn?t really matter too much.

The main idea here is that the projects and tasks is out of your email inbox and inside a system where you can see the history and match tasks with people who can do them.

But before we dive into the advanced outsourcing strategies we need to discuss why we?re outsourcing in the first place. Bare with me here, there will be a point later.

Objectives

Why is it that a small business would want to utilize outsourcing? Well depending on the size of the business that can be long list, but remember that we?re only talking about either start-ups or small businesses.

I?ve defined three main categories

  • Save Time ? You want to be able to use your own internal time for something more constructive.
  • Save Money ? You want to have something done in a country where it can be performed cheaper than in your own country.
  • External Expertise ? You want to buy some expertise that you don?t currently have in your own business.

The last one can be tricky since it?s notoriously hard to outsource tasks you do not know how to do yourself. As an example how would you instruct someone to do a task you did not know how to do yourself? And if that succeeded how would you be able to check the delivered quality if you did not know about the process?

But the first two, save money and save time are fairly self-explanatory.

Now the reason why I wanted to mention these objectives for outsourcing is that this is often where things go wrong.

Instead of doing a certain tasks yourself, you end up spending the same amount of time describing the tasks and managing the person/team that you?ve outsourced to. And then what have you saved? I?ve heard a lot of frustrated business owners saying that it would have been quicker to simply do the taks themselves.

You can also fall into the trap where the project or task will actually take more time to do for someone on the other side of the planet than for a person in your own country. This will therefore equal out the difference in price.

Specially in the IT business where I?ve spend a lot of time there is some kind of management belief in that you can just replace a developer in your own country with one from India and cut 70% of the cost. Problem is that the people making these decisions are management people with calculators and spreadsheets, not developers themselves and they very often fall into the trap of ?not knowing what they?re outsourcing?. Sorry? just a quick rant, but in my experience, 4 out of 5 IT projects outsourcing ends up being a really bad experience.

So what are some of the comon pitfalls that you can experience as a small business owner wanting to utilize outsourcing successfully.

Pitfalls

  • Micromanagement ? You end up sending mails all day long and being on endless Skype calls even with just a couple of people. This results in you not having any time to focus on what you really should be focusing on, developing your business.
  • Error Rate ? Everything seems to come back incomplete or simply half done. You spend all your time doing quality assurance checks and emailing back and forward everytime to find yet another thing missing from the delivery.
  • Scaling ? You can have found a great setup where everything seem to work. This is typically something that has been built over a longer period after a lot of trial and error. But now you are having trouble scaling this business because it involves you to train new people and let them know about your business.

Well I?m glad that you made it this far, because these issues are the ones that my strategies in this article are addressing.

So let?s take a look at the first advanced strategy.

Process Automation

The most important take away from process automation is to start thinking in processes instead of tasks and projects. There are of course always one-off tasks but if you have people hire part time or full time and not just for a single project, then you should start thinking in processes.

Defining a process has the benefits that it?s

  • Visible to everybody
  • Optimizes quality in the delivered work as it is done the same way each time
  • Easy to get new employees up to speed
  • Can be tweaked and optimized over time as you get feedback from the use

So how can you create a work processes? Well there are a number of ways. Below are some of the different examples that I have used in the past.

  • Checklists are probably the most simple thing to create. As someone does a task they have to follow this list. This most likely be done in a single page of text (formatted as a list)
  • Step by step process is a bit more elaborate than a simple checklist. Here you typically describe each step of the process in details. This could span several pages and include images such as screenshots where appropriate.
  • Screencast where you record your own screen while you are performing the given task. I use Screenflow because I?m on a mac but if you are on a pc you might want to look into Camtasia (although a little on the expensive side). Screencasts are also really great if you want to show a specific thing outside the process such as an error or similar. I use it all the time.
  • Weekly schedules is another great thing you can do. I had one guy doing some search engine optimization working for me and he basically had some tasks that should be done each week. So I created a weekly schedule for him with entries each pointing to a step by step process description. One example was that in the beginning of each week he had to send this week?s keywords to an article writer, so there were process descriptions on how he got the keywords and how/who/when he should send them to the writer.

But where should all these documents/videos be stored? There are different places. The easist thing I?ve found is simply to store them in a Dropbox account where you create a ?Business Processes? folder and share it with your employees.

I have experimented with creating a real intranet for my company and putting all the processes here, but the problem is that then I need to maintain an intranet and while it might look snappy and sound awesome to have an intranet, it?s mostly just a hazzle.

Most of the time I just upload videos to Youtube and mark the video as unlisted. It?s really easy to do directly from my screencasting application so I don?t need to go to Youtube and upload myself.

Decision Automation

This kind of automation is all about letting your employees think for themself. Yes I know they should be doing this already, but fact is most of the time they are simply doing what you are asking them.

But here we are talking about you empowering them to make their own decisions that might even cost you money. Now hold your horses, I?m not asking you to give them your credit card or anything. But one decision could be one that would take some time implementing for the employee and that would then cost you the time he or she spent doing it.

So there are two kinds of decision types that you can empower your employees with:

  1. Money
  2. Time

The whole idea about decision automation is that you set up some rules or limits that your employees can act within. We can describe the two different types of limits like this:

  • Money limits ? I did tell you not to give them your credit card, right? One example however could be the one that Tim Ferriss mentions in The 4-Hour Workweek where he says that his support team can make decision costing him up to $100 (later raised). So when a customer calls the support team and says that he hasn?t received a package, they can just send him a new one without involving Tim. I?m not in the physical product business, so I haven?t had to give these kinds of instructions, but you might need to.
  • Time limits ? If your employee experiences trouble, how long time can they spend on solving the problem before they need to notify or alert you? This could be setting a timespan on a given tasks like ?you can spend 10-30 hours on this but alert me after 20 hours if you can see that you will need more than 30 hours? or simply tell your employee that they can spend up to X hours fixing problems or unforseen issues in regard to their job before alerting you. But if you do so, make sure that you can trust your employees, this is not a rule I would start out with without knowing my people really well.

Improvement Automation

So now you have your outsourced team running on tracks, but how do you improve and evolve your business?

I guess that you are mostly the person doing any business development in your company, right? But why not have a formal way of getting input from your outsourced team as well?

There are two main categories that I want to mention

  1. Process Improvements, and
  2. Business Ideas

The most obvious candidate for improvement is of course the processes that you?ve created. They are using them everyday so if something is unclear or difficult to follow, or if something could be done much easier, your guys (and gals :) ) are the ones who can provide you input on it.

The second candidate for improvement is your business itself. It could be that a person on your team had an idea on how you could easily improve a product or perhaps bring it to a new market. So why not listen and better yet, have a formal strategy for how your team can contribute their own ides.

This last strategy can be quite hard to implment in practice. In some cultures employees are not used to saying or doing anything that lies outside the directions they have been given from their employer/boss. So I do not recommend doing this with a new team.

You need to create an atmosphere where you welcome new ideas and actively tell them that you do. Also if you create a ?process? for contributing ideas or process improvements, you are also actively telling your team that it is expected of them.

Besides creating a process for improvements you should also always appriciate every idea you get. Even if you don?t end up implementing it or even liking it. If someone gets laughed or ridiculed at for bringing an idea to the table, they most likely won?t contribute with another idea. And it would be a damn shame if it was idea number two that would have doubled your business, right?

Summary and Stuff

So there you have it. If you are already doing some outsourcing and want to take the next step then you should consider implementing these strategies.

It?s not always easy, but once you get them running you will see that you will have much less management, higher quality and a happier team.

For the past 15 years of my life, I have very heavily invested a great deal of my time, energy and money into the field of social?entrepreneurship with a firm belief that?we needed to take very significant and powerful actions to end, or at least severely diminish, poverty. The clearest path toward greater economic equality is to fundamentally?increase the financial and political power the disenfranchised have in very direct, clear and?quantifiable?ways so that they may climb out of poverty by creating wealth. This practice is the foundational cornerstone of social?entrepreneurship.

Over the years, social entrepreneurship has greatly expanded in popularity and I have seen all sorts of individuals, teams and organizations join our ranks to create what is starting to form into an ecosystem. I?ve observed the term used in all sorts of ways to describe all sorts of things, (including people and companies who have nothing to do with this space calling themselves social?entrepreneurs?and social enterprises simply because they use social media as a business tool).

Many other people and companies misappropriate or confuse the term as a clever marketing tool, for their corporate social?responsibility, or?business?s charitable giving and/or?philanthropic?efforts.?Many of these things are well intentioned and some even have good impact and make a?difference?in the lives of folks and their communities. Yet, the fact of the matter is none of this is actual social?entrepreneurship.

Well, for the past three months I?ve been having lots of conversations here in Philly, which is chuck full of social, economic, political and environmental problems, defining specifically what social enterprise is,?what is its goal and what exactly is the change that it was created to foster and what it looks like. Then I ran into this?awesome Norman Rockwell painting?that illustrates the point very well. Rockwell successfully uses art for?transformational?change. When done properly, that social?entrepreneurship?can have the same impact. To expound further, that painting correlates with this?quote from Dr. Martin Luther King:

?The ultimate measure of a man is not where he stands in moments of comfort and convenience, but where he stands at times of challenge and controversy. The true neighbor will risk his position, his prestige, and even his life for the welfare of others. In dangerous valleys and hazardous pathways, he will lift some bruised and beaten brother to a higher and more noble life.? -?Dr. Martin Luther King,?Strength to Love.

This philosophy and practice is very much what my role model and hero,?Muhammad Yunus, put into place when he created?Grameen Bank.?Yunus spent 30 years of his life working as an employee of Grameen, accountable to the owners and board members who were the bank customers, and the?disfranchised?women he set out to help. He did it before micro credit/finance became sexy. He did this as a highly esteemed economics professor with a very comfortable life and social standing in his community and caught a ton of?criticism, laughs, naysayers and attacks?for it at first from various angles, not just the loan sharks but even the do-gooders and the general population as well as his friends, family and colleagues.

Because his work and vision were a cultural soci-economic revolutionary act which did not ?make an impact? but created a transformational force that empowered a generation of women beggars (basically unwanted property in that culture) to become entrepreneurs with agency and control of their lives and their destiny. The effects reverberated to their next generation, who were able to attend school and be better off than them.

It is up to this and the coming generations of social entrepreneurs and those they work with to improve on his model and keep on partnering with the world?s disenfranchised so?they?can keep building even more soci-economic wealth for themselves and their prosperity. That is?transformational power that which?social entrepreneurship?was created to foster.

SCRS Open Meeting to be Held at SEMA Collision Repair ...

The Society of Collision Repair Specialists (SCRS) will hold an open meeting on Oct. 30 from 5:30 p.m. to 7 p.m. at the SEMA Show Collision Repair and Refinish Stage, located in the Collision Repair & Refinish section of the North Hall of the Las Vegas Convention Center near booth 10877.

The meeting will not only provide attendees with an afterhours vantage point of the show floor, but will provide insight into SCRS? 2012 initiatives and activities. The meeting precedes other industry events held throughout the week, both on the show floor and at the adjacent LVH hotel property. ?

The evening association meeting will include updates from SCRS Chairman and Executive Director Aaron Schulenburg, outlining current and future work initiatives the association has undertaken on behalf of its membership. ?

Attendees can expect specialty presentations from committee members and guests, including a detailed presentation from the SCRS Education Committee, led by committee member Toby Chess. This presentation will detail critical safety information about the importance of correct windshield bonding procedures, the materials available to the marketplace, and the equipment and training necessary to address the structural nature of today?s glass installations.

In addition to SCRS committee reports, Toyota Motor Sales Collision Business Development Consultant Rick Leos will present advancements the manufacturer is making to provide comprehensive estimate data to aid in the preparation of repair blueprints that reflect OEM-recommended procedures.

This meeting is open to any member of the industry who wishes to attend, and there is no registration fee.?

GANDALF'S FIST From A Point Of Existence music review by Dr Ball

5 stars Great. Balls. Of. Fire. What an absolutely cracking album. Whilst members of the progarchive community may recognise that Gandalf's Fist has hastily became one of my top 2 favourite bands, I should make a quick note that this album surpasses all expectations I had for the little Cumbrian duo and is an essencial piece of work that would fit handsomely and impressively into any prog lovers music collection. It is adventurous and diverse with lots of cheeky motifs one does not expect to come flying out of the laptop speakers, through the pantry, and into the sitting room whilst one is nonchalantly eating muesli - this is an epic and should be treated as such!

The introductory track made my organs feel a bit unsettled, but in a good way...the anticipation in this short sequence is incredible and opens for the marathon monster 15 minute + title track that makes even an M.D like me feel inferior to these two musical warriors. My favourite track (today at least) is 'There and Back Again', an obvious homage to Tolkien with a bit of an 80s ballad vibe - a great departure from GF's usual style but with excellent results! The simplicity brings the album back to earth in contrast with the complexity and mind-melting quality of some of the other tracks, showing the duo are not just your usual prog privateers, but instead are capable of bringing much more to the feast, in the form of a sprinkling of metal, a dash of psychedelic rock and a thin slice of cheese.

Equally impressive is the standard of complementary artwork for this album. GF's page narrates in some manner about some space age conspiracy story about an Ice cream man named William Small; the hallucinogenic ice cream and disgruntled robin takes me back to the day when music and art didn't have to make sense or have an 'agenda'... it just had to smell and taste like tangerines.

For those suffering from confusion over what constitutes as music nowadays, Dr Ball prescribes the PURCHASING of this album and 18 hours in the bath listening to it on loop, whilst pretending you are a giant and vicious sea worm breaking the balls of musical pirates.

Australian Radio Commentator Alan Jones to Take Factual Accuracy Training for Global Warming Comments

Australian radio commentator Alan Jones has been ordered to undergo ?factual accuracy? training over his remarks denigrating man-made global warming, local media relates.

Jones apparently said Australians produce just ?1 per cent of .001 per cent of carbon dioxide in the air,? and that ?nature produces nearly all the carbon dioxide.?

But, the Sydney Morning Herald continues:

University of Melbourne climate change scientist David Karoly said Australians were in fact responsible for .45 per cent of total carbon dioxide in the atmosphere. ?Obviously, we would much rather prefer that the comments of people like Alan Jones and Andrew Bolt were, in fact, correct, so it is pleasing to get this ruling from [the Australian Communications and Media Authority],? Dr Karoly said.

The radio station told ACMA Jones? claims should have been taken as commentary?But the authority said any ?ordinary, reasonable listener? would have taken his claims to be fact.? [Emphasis added]

The radio?s news and current affairs staff will also be participating in the training, and while Jones has apologized for his remarks, he still seems pretty defiant.

Questioning whether this is ?another chapter in the campaign of punishment for anyone who dares challenge the prevailing Government ideology of global warming,? Jones says his program is ?fastidious? about getting their facts right, and certainly apologizes for misquoting the reported amount of carbon dioxide emitted by Australians.

However, while many of the man?s detractors are celebrating the news, others are calling it ?scary.?

Nigel Milan, a former chief executive with the radio station, explained:

?Are we to assume Alan Jones?s listeners (and there are a lot of them) have but one source of information??With the power of social media campaigns and the strongest libel laws in the country, do we really need the Australian Communications and Media Authority and the federal government to protect us? I think not. Indeed, whatever you think of Jones?s views, surely the thought of a government-controlled media is more scary.?? [Emphasis added]

The IPKat: Speaking About Trade Marks: Ready My Lips?

This Kat recently had the pleasure of speaking in Chicago at the INTA-sponsored conference on "Trademarks on Transactions". Having spent an oversized number of his
higher education years in Chicago, it was great to return there for three days of glorious autumn weather along the shores of Lake Michigan.

Back home in the blogging saddle and reflecting once again on the conference, one topic particularly grabbed this Kat's attention. As part of the session on "Legal, Business and Tax Issues Involving Related-Party Transactions," discussion was had on the pros and cons of consolidating all trade mark registrations in a single company within a larger corporate group. One claim made in favour of such a move is that, in so doing, the trade mark owner is in a more sound position to support a claim that the mark is well-known.

If a given mark is held by a number of related entities, it might be more difficult, so it was asserted, to prove that the mark has become well-known, even if the mark is used widely and enjoys recognition on a world-wide basis. The thinking expressed was that, because ownership is split, no single entity can presumably claim the world-wide fame of the mark, thereby weakening any argument that such the mark is well-known. For that reason, from the point of view of establishing that a mark has acquired well-known status, unitary ownership of the mark across multiple jurisdictions is the way to go.

This Kat pondered this assertion but he felt a sense of unease about it. He took advantage of the Q&A to ask: "Was anyone on the panel aware of any case law that had addressed this question?" In particular, did anyone of them know of a judgment in which well-known mark status was rejected because the mark in question was not held by a single entity but rather by a number of related companies, despite the fact that the mark itself enjoyed a substantial reputation in a large number of countries across the world? None of the panelists could point to any such decision. Nevertheless, it was argued, a consideration of whether or not the mark was held by a single or multiple entities impacted on claiming well-known mark status. In other words, the situation seems to be that, while there is no specific legal authority for the position, as matter of practice the position has obtained a measure of acceptance. With that, the issue rested.

The exchange above was interesting not only for the legal question raised, but for raising a fundamental question in connection with the mores of a professional presentation. How much leeway does a speaker have when he advances an unsettled legal assertion without being aware of any supporting case authority? This Kat is not naive (he hopes)--when one speaks, one may seek to advance a proposition, even in the absence of any known legal authority. Such suggestions are often the most tantalizing part of a presentation.

But, in so doing, does the speaker have an obligation to clarify the context in which the suggestion is being made? Should the speaker state whether his proposition is supported by case law and or accepted practice or whether the speaker has even checked the legal position? Or perhaps not: a presentation is not a published professional article. Perhaps the purpose of an assertion in a presentation, such as the suggestion that the potential risk to a claim of well-known status of a mark in the event of split ownership of a mark across various jurisdictions, is to challenge the audience to pursue the matter further if interested? Even here, however, should there not be at least a minimum check about the legal plausibility of the claim? As this Kat already prepares for his next public presentation, he is considering these questions anew. .
